    Is NuLeaf a licensed Medical Marijuana dispensary?

     

    Yes, we are the only Nevada state-approved medical cannabis provider in Lake Tahoe. As part of that authorization, we adhere to the rules and regulations set forth by the Nevada Division of Public and Behavioral Health (“Division”) to ensure patient and product safety.

     

    How do I know if I am eligible for the Nevada Medical Marijuana Program?

     

    Persons suffering from the following debilitating medical conditions as defined in NRS 453A.050 may be eligible for the Nevada Medical Marijuana Program:

     

    AIDS

    Cachexia (general physical wasting and malnutrition from chronic disease)

    Cancer

    Glaucoma

    Post-Traumatic Stress Disorder (PTSD)

    Persistent muscle spasms or seizures (including Multiple Sclerosis)

    Severe nausea

    Chronic pain

    Seizures (including Epilepsy)

     

    Other conditions are subject to approval

     

    How do I obtain a Medical Marijuana Patient Card?

     

    You must first request an Application Packet for the Nevada Medical Marijuana Program from the Nevada Division of Public and Behavioral Health (DPBH). You may mail in a written request for the application or pick one up in person from the DPBH (4150 Technology Way Suite 104, Carson City, 89706). There is an upfront, $25 fee for obtaining the Application Packet.

     

    Alternately, you may now register and download the application packet online from the DPBH through the Online Cardholder Registry. Using the online application process may significantly reduce the time it takes to get your patient card, and the $25 fee does not need to be paid upfront when registering online.

     

    The Application Packet consists of an Application Page, Waiver, Acknowledgement Form, Attending Physician’s Statement, Caregiver Application (if needed), Minor Release Form (if applicant is under 18 years of age), and Proof of Nevada Residency. The Waiver, Acknowledgement form, and Minor Release form (if used) must be notarized. The Attending Physician’s Statement must be filled out and signed by a Board Certified Medical Doctor or Osteopathic Doctor licensed in the State of Nevada.

     

    Once the Application Packet is completed it may be returned to DPBH, either in person or through the mail (4150 Technology Way Suite 104, Carson City, 89706), along with the $75 registration fee (and the $25 application fee, if not paid upfront).

     

    When your application is approved you will receive a Temporary Acceptance Letter from DPBH, valid for 60 days. You must then take the Acceptance Letter to a Nevada DMV location to apply for the Medical Marijuana Patient or Caregiver card. A small, additional fee is required. Your card should arrive in the mail within 10-14 days. In the meantime, the 60 day Temporary Acceptance Letter should serve as proof of acceptance into the Nevada Medical Marijuana Program, enabling you to purchase marijuana from licensed dispensaries until your card arrives.

    How do I find a Doctor who can recommend Medical Marijuana?

     

    Any medical doctor or doctor of osteopathy licensed by the State of Nevada (and in good standing) can recommend an individual for a medical marijuana card. Bringing copies of past medical records to your doctor's appointment can help demonstrate the history of a chronic or debilitating condition and help establish the need for medical marijuana. However, a doctor’s recommendation is not a “prescription”. You must complete the application process and be accepted into the program in order to purchase medical marijuana.

     

    Some physicians specialize in making these recommendations and some health centers have Notaries Public on staff and can assist you with completing the Application Packet.

    I understand that Medical Marijuana is legal under Nevada state law, but isn’t it still illegal under Federal Law?

     

    Under the Federal Controlled Substances Act, marijuana remains classified as a Schedule I drug. It is viewed as having no acceptable medical value and is illegal. However, in 2013 the Department of Justice (DOJ) issued a guidance memo to prosecutors which it made clear that prosecuting state legal medical marijuana cases is not a priority. Federal laws tend to be applied only to persons who possess, cultivate, or distribute large quantities of cannabis. It is important to keep in mind that your registration as a Nevada Medical Marijuana Patient with a valid Cannabis Card neither protects nor exempts you from prosecution under federal law.

     

    How much Marijuana am I allowed to purchase?

     

    Registered Medical Marijuana Patients or Caregivers may purchase up to 2½ ounces of dried cannabis flowers--or the equivalent in edible marijuana products and marijuana-infused products--every 2 weeks. It is illegal to resell marijuana or marijuana products to others.

     

    can i purchase medical marijuana in NEVADA if I have an out of state medical marijuana card?

     

    Yes, Nevada recognizes Medical Marijuana cards from other states that have Medical Marijuana programs. Patients from other states where Medical Marijuana is legal will be able to shop at Nevada dispensaries as long as they posses a valid ID and a verifiable cannabis card from the state in which they reside. Cannabis products purchased in Nevada must be consumed in Nevada, however, as it is illegal to transport over state lines. Everyone will be subject to the 2½ ounce possession limit.

     

    Can I grow my own plants at home?

     

    Registered Nevada Medical Marijuana Patients may legally grow up to 12 plants if they register the address (of where they’re growing) with the state. Patients who live within 25 miles of a dispensary won’t be allowed to grow their own marijuana without a special exemption from the state. Patients who are cultivating specific strains of cannabis not provided by a local dispensary may continue to engage in the home cultivation of such strains.

    What about Caregivers?

     

    Nevada's Medical Marijuana policy allows for the designation of a Primary Caregiver, a person who is significantly responsible for managing the well-being of a patient who has been accepted into Nevada’s Medical Marijuana Program. Medical Marijuana patients can designate only one Primary Caregiver who must be at least 18 years old and cannot be the patient's attending physician. Once you are registered as a patient, a caregiver may be added to your account by following the same registration and application process. A person can only be a caregiver to one cardholder, and a cardholder cannot be a caregiver to another cardholder.

     

    The caregiver is eligible to purchase Marijuana products on behalf of the patient. Primary Caregivers may not be arrested, prosecuted, or subject to other legal sanctions under Nevada law for possession, cultivation, or delivery of medical cannabis. Caregivers must be designated by the patient and receive a registration identification card from the State of Nevada. They are subject to the same rules and regulations as Medical Marijuana Patients.
